Conclusion of a service agreement.
This agreement is a public offer and does not require signing (in accordance with Article 387 of the Civil Code of the Republic of Kazakhstan). A public offer agreement has the same legal force as a contract signed on paper.
1. GENERAL CONDITIONS AND PROVISIONS
These terms and conditions apply to all services provided by Asia Genetic Group LLP, operating under the name TravelConnect, hereinafter referred to as the "Seller," for the resale of prepaid eSIM cards.
The following terms and conditions are presented on the website https://travelconnect.kz/ The Seller may change these terms and conditions only with explicit written consent.
1.1. This offer is the official offer of the online store «travelconnect.kz», hereinafter referred to as the «Seller», to conclude a contract for the sale of goods by remote means, i.e. through the online store, hereinafter referred to as the «Contract», and places the Public offer (offer) on the official online website of the Seller «https://travelconnect.kz» (hereinafter referred to as the «Internet site»).
1.2. This Contract defines the conditions for purchasing any of the products listed, hereinafter referred to as the «Product», by the Buyer through the online store of the Seller.
1.3. The contract is public according to Article 387 of the Civil Code of the Republic of Kazakhstan and is equivalent to an "oral agreement" and has the appropriate legal force.
2. DESCRIPTION OF SERVICES
2.1. eSIM SALE
The seller resells prepaid eSIM cards. The client registers and purchases eSIM cards on the website https://travelconnect.kz/ and/or in the Merchant's app. Payment is made via CloudPayments processing center with a Visa or Mastercard bank card.
2.2. REGISTRATION TO USE TRAVELCONNECT SERVICES
The Customer must accept the general terms and conditions in order to use the Seller's services. The Customer provides the following information directly or through a service provider (hotel, travel agency, etc.) in a web browser on the website https://travelconnect.kz/: Name, surname, address (payment address), and email address.
2.3. TRAVELCONNECT DUTIES
The Seller will make reasonable efforts to provide high-quality service to the Customer. However, the Seller does not guarantee that the service will be provided on time or without interruptions, nor does it guarantee security or the absence of failures.
2.4. CLIENT'S OBLIGATIONS
When using the eSIM provided by the Seller's company, the Customer is prohibited from performing any offensive, illegal, or fraudulent actions, as well as actions that may cause damage to the Network. In the event of a violation of the Customer's obligations under Section 2.4, the Seller's company may suspend the Customer's use of the Service. The Seller will notify the Customer of the suspension as soon as possible. During the suspension, the Customer is required to pay all Payments under this Agreement for the suspended Services.
2.5. DEVICE COMPATIBILITY
It is the Customer's responsibility to ensure that the device is eSIM-compatible and not carrier-locked. By checking the "Device is eSIM-compatible and not carrier-locked" box to proceed with the purchase, the Customer is responsible for providing this information. The device's compatibility may vary depending on the carrier and country of origin, so the Customer should refer to the list of eSIM-compatible devices available during the checkout process. The list of eSIM compatibility is not exhaustive, and it may not include recently announced eSIM-compatible devices.
3. BEGINNING, DURATION, AND TERMINATION OF THE AGREEMENT
The eSIM sale agreement between the Seller and the Customer becomes effective after the Customer places an order on the Seller's website https://travelconnect.kz or through the app. The Customer is responsible for activating the eSIM and complying with the Activation Rules. If the Customer does not have an active data package or if they have removed the eSIM from their device, the agreement will be terminated.
4. PAYMENTS AND ACCOUNTING
4.1. PAYMENT TERMS
The cost of an eSIM is paid by credit card, via CloudPayments processing center by Visa or Mastercard bank card.
4.2. USER FEES
4.2.1. All payments for the Seller's services are made without VAT, unless otherwise specified.
4.2.2. The Customer does not have the right to set off their claims against the Seller, unless the Customer's claims are disputed or confirmed by a final court decision.
5. DELIVERY
The customer will immediately see the purchased eSIM on the "My eSIM" tab on the website and / or in the app. After the purchase, the Customer will receive a confirmation email. All information on installing the eSIM will be provided only in the Merchant's user account.
6. POLICY ON RETURN OF FUNDS, CANCELLATION AND CORRECTION
If the eSIM cannot be installed or used due to a technical issue on the Seller's end, the Customer has the right to request a refund or adjustment.
6.1. RETURN OF FUNDS AND CANCELLATION
6.1.1. POLICIES AND RECOMMENDATIONS
6.1.1.1. A refund request can be made within thirty (30) days of the date of purchase, but only if activation is still not possible after a thorough search and troubleshooting.
6.1.1.2. If the eSIM is already in use and there is a problem on the Seller's side that cannot be resolved in a timely manner, the funds for the remaining traffic may be refunded.
6.1.1.3. The Client's cooperation is crucial for resolving the issue as soon as possible, otherwise a refund may not be possible.
6.1.1.4. Traffic packages have an expiration date. After the expiration date, no refunds will be provided for the remaining traffic in any form.
6.1.1.5. Compensation. Refunds and any kind of compensation are not provided for payments for other phones, other SIM cards, hotel phones, and other payments that are not directly related to the Customer's eSIM account. (See Section 7. LIABILITY AND WARRANTIES in the Terms and Conditions.)
6.1.1.6. Fraudulent purchase. The Seller reserves the right to refuse any refund if there is evidence of abuse, violation of our terms and conditions, or other fraudulent activities related to the use of the Seller's products and services.
6.1.1.7. Unauthorized purchase. Before refunding funds, such cases will be investigated and verified. The seller reserves the right to suspend the account associated with any fraudulent activities.
6.1.1.8. Random purchase. The eSIM card is considered used after it is installed by the Customer. In this case, no refund is offered.
6.1.1.9. Incorrect charges. If the Customer reasonably and in good faith disputes the invoice or part of it, they must notify the Seller of such a dispute within 12 days of receiving the invoice and provide detailed information about why the amount charged is incorrect and, if possible, what the Customer believes the correct amount should be. (For more information, please refer to Section 4.2 of the Terms and Conditions.)
6.1.1.10. Other reasons. If the refund request does not meet the above requirements, we will consider it on a case-by-case basis. If the refund is approved, a processing fee may be charged. The maximum amount of credit that can be refunded must be equal to or less than the total amount paid by the Customer.
6.1.2. RETURN PROCESS
To request a refund, please send an email to support@travelconnect.kz. Please note that our refund policy, as described above, will apply. Depending on the nature of the issue, customers may be asked to provide additional information to support their refund request, such as screenshots of their device settings (in the case of technical issues) or details about why the billed amount is incorrect and, if possible, what the customer believes the correct amount should be. For information on refunds due to technical issues, please refer to section 6.1.2 of this document. Customers will have the option to return funds to their original payment method. Return to original payment method: It may take 5-10 business days for the refund to appear in the statement, depending on the bank.
6.2. CORRECTION
eSIM traffic packages from the Seller are offered as is. After their purchase, adjustments and modifications are not possible upon individual request.
7. LIABILITY AND WARRANTY
The seller is not responsible for any damage caused as a result of the service not being available or being available intermittently. The seller does not guarantee the continuous availability of the network service. For any questions, please contact support@travelconnect.kz
